VamoTrip Terms of Service

Acceptance of Terms

By accessing or using VamoTrip (“VamoTrip,” “we,” “us,” or “our”) and our travel-planning chatbot service (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Service. We may update these Terms from time to time by posting the revised Terms on our website with a new effective date. Your continued use of the Service after any changes are posted constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically for updates.

Service Overview

VamoTrip provides an AI-powered conversational chatbot to help users plan travel itineraries, discover recommendations, and find personalized travel experiences. Important: VamoTrip itself does not sell flights, accommodations, tours, or other travel products. When our Service helps you find travel options, any actual booking or purchase is handled by independent third-party providers (e.g. airlines, hotels, tour operators, ticket agencies) through integrations or external links. VamoTrip may redirect you to third-party booking platforms (such as Viator or airline/hotel partners) or assist in transmitting your information to such platforms to facilitate a reservation. All bookings or purchases you make are solely between you and the relevant third-party provider, not with VamoTrip, and will be governed by that third party’s terms and conditions.

The Service is experimental and may be unavailable, inaccurate, or incomplete. You use it entirely at your own risk. VamoTrip is not yet a registered company, but these Terms govern your relationship with the operator of the Service. The Service is provided “as is” and “as available”. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, without any liability to you.

Eligibility

Age Requirement: The Service is intended for individuals who are at least 16 years old (or the age of majority in your jurisdiction, if higher). If you are 13–15 years old, you may only use the Service with the consent of a parent or legal guardian. The Service is not available to anyone under 13. By using VamoTrip, you confirm you meet this requirement.

Third-Party Services and Bookings

Third-Party Travel Providers

As noted, VamoTrip is a planning and recommendation tool; we are not a travel agency or vendor. Any bookings for flights, hotels, tours, car rentals, or other travel services are fulfilled by third-party partners (each a “Travel Partner”), not by VamoTrip. We may help by deep-linking you to a Travel Partner’s website or by collecting details (e.g. trip selection, traveler information) to pass to a Travel Partner. All bookings are subject to the Travel Partner’s terms and conditions and privacy policy, and you should review those carefully. VamoTrip does not assume any responsibility or liability for reservations made with Travel Partners. We do not control (and do not guarantee) the availability, quality, pricing, or fulfillment of any travel option provided by a third party. Any issues or disputes related to a booking (such as cancellations, changes, refunds, no-shows, travel disruptions, or customer service questions) must be resolved with the Travel Partner directly, according to their rules.

No Endorsement

References or links to third-party products, services, or websites on VamoTrip (including Travel Partners or any other third-party content) are provided for your convenience. Such references do not imply endorsement by VamoTrip. We do not control third-party content and are not responsible for its accuracy, legality, or any harm or losses arising from your use of it. When you click a third-party link or integrate with a third-party service via VamoTrip, you do so at your own risk and will be subject to the third party’s terms and policies.

Third-Party Integrations

VamoTrip may integrate APIs or services from third parties (for example, travel search engines, mapping services, or AI platform providers). We are not responsible for any acts or omissions of those third-party services. For example, our Service might use mapping services to show locations; by using those features, you agree to the respective map provider’s terms (e.g. Google Maps Terms of Service) which may apply to you. We are not liable for how third-party services handle your data or perform.

Acceptable Use Policy

You agree to use VamoTrip lawfully and respectfully. You must NOT:

  • Violate Laws or Rights: Use the Service in any manner that violates any applicable law or regulation, or infringes the rights of anyone else (including intellectual property rights and privacy rights).
  • Submit Harmful/Illegal Content: Submit, upload, or transmit any content through the Service that is unlawful, fraudulent, harassing, defamatory, obscene, sexually explicit, harmful or dangerous (such as content that promotes violence, hate, or criminal activity), or that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Misuse the Service: Introduce any viruses, malware, Trojan horses, or other harmful code; disrupt or interfere with the Service’s normal operation or with other users’ use of the Service (including spamming, flooding, or launching denial-of-service attacks); or bypass or circumvent any access controls or Service limitations (e.g. attempting to hack or disable security features).
  • Impersonate or Harvest Data: Impersonate any person or entity (or falsely imply an affiliation with either) when using the Service, or collect information about other users without their consent. You may not harvest, scrape, or gather data from the Service via automated means (such as bots or crawlers) without our prior permission.
  • Abuse the AI Assistant: Engage in behavior that threatens the integrity of our AI assistant or platform, such as attempting to manipulate the AI into violating these Terms, or using the Service to generate content that is prohibited above.

We reserve the right to monitor usage, investigate any suspected breach of this Acceptable Use Policy, and take appropriate action. Violation of these rules may result in suspension or termination of your access (see Termination section below) and may also expose you to legal liability.

Intellectual Property and Content Ownership

Our Content:All software, code, algorithms, text, graphics, logos, designs, databases, compilations, and interfaces of the Service (collectively, ‘Service Content’) are owned by VamoTrip or its licensors. This does not include User Content or AI-generated content, which are addressed separately below. This Service Content is protected by copyright, trademark, trade secret, and other intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service Content for your own personal, non-commercial travel-planning purposes and strictly in accordance with these Terms. You may not copy, reproduce, distribute, publicly display, or create derivative works from our Service or Service Content without our express prior written permission, except as allowed by law or as part of normal use of the Service (for example, you may temporarily save or print an itinerary for your personal use). All rights not expressly granted to you in these Terms are reserved by us.

Trademarks

“VamoTrip” and any names, logos, slogans, or other identifiers used in connection with the Service are commercial identifiers used by us in trade. No rights to use these identifiers are granted to you. Other product and company names that may appear in the Service are the property of their respective owners. Any unauthorized use of our identifiers without prior written consent is prohibited and may violate applicable laws on unfair competition and protection of commercial designations.

User Content

User Content: “User Content” means any information or material you enter or submit when using the Service (including text you input into the chatbot and feedback you provide). You retain all rights in your User Content. By providing User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, transmit, reproduce, and otherwise use such content solely for the purposes of: (i) operating and providing the Service; (ii) transmitting your queries to third-party AI providers (e.g., OpenAI, Google) for generating responses and delivering such responses back to you; (iii) ensuring security, logging, diagnostics, and analytics; and (iv) creating aggregated or de-identified data to improve the Service. We do not control how third-party AI providers (such as OpenAI or Google) handle data once transmitted. We do not have a zero-retention agreement with these providers, which means your inputs may be logged, stored, or used by them under their own terms and privacy policies. By using the Service, you acknowledge and accept this risk. Responses generated by AI models based on your inputs are provided for your personal use. We do not claim exclusive rights in such responses and make no guarantee as to their uniqueness, accuracy, or suitability for any purpose. You represent and warrant that you have the necessary rights to the User Content you provide and that its submission and our processing under these Terms will not violate the rights of third parties or applicable law. You should not submit confidential information or any material you do not intend to disclose.

Feedback

If you choose to provide us with any suggestions, ideas, bug reports, or other feedback about VamoTrip (“Feedback”), you agree that we can use and share such Feedback for any purpose, without restriction or compensation to you. Feedback is entirely voluntary and helps us improve the Service.

AI-Generated Content

AI-Generated Content: The Service may generate travel suggestions, itineraries, or other text using artificial intelligence. Such AI-generated content is provided for informational purposes only. AI-generated content is not guaranteed to be original or eligible for copyright or other intellectual property protection. You may use the content for your personal, non-commercial purposes, but you should not assume that it is unique to you or that you have exclusive rights to it. The same or similar outputs may be generated for other users. VamoTrip does not warrant that any output will be free from overlap with third-party materials. VamoTrip disclaims any liability for the use, misuse, or reliance on AI-generated content, including any claims of infringement or similarity to third-party works. You are solely responsible for how you use such content. AI-generated responses are produced by third-party AI providers. Because we do not have a zero-retention agreement with these providers, your chat inputs may be retained or used by them in ways governed by their own terms. VamoTrip does not control or guarantee how long such data is stored or whether it may be reused by the provider.

Third-Party Content

The Service may display content provided by third parties – for example, descriptions, reviews or images of hotels, tours, or destinations, or social media content via plugins. All such content remains the property of its respective owners. VamoTrip does not claim ownership of third-party content and is not responsible for any third-party content’s accuracy or reliability. If you believe that something on our Service (including any AI-generated content) infringes your copyright or other intellectual property rights, please notify us at our contact email (provided at the end of these Terms) with details of the alleged infringement. We respect intellectual property rights and will respond to proper notices in accordance with applicable law (such as the Digital Millennium Copyright Act in the U.S.).

Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information in connection with the Service are described in our Privacy Policy (available on our website). By using VamoTrip, you acknowledge that you have read and understand our Privacy Policy. In particular, note that since our Service is an AI chatbot, any information you input in the chat might be processed by AI systems (including third-party AI providers) to generate answers. While we do not require you to provide personal data to use the basic Service, any personal information you do choose to share will be handled as described in the Privacy Policy. Please note: we do not have a zero-retention agreement with these providers. Your chat inputs may be stored or otherwise processed under their independent privacy policies, which are outside our control. If you do not agree with our data practices, please do not use the Service or provide personal information.

Disclaimer of Warranties

VamoTrip is an AI-based service and is provided on an “as is” and “as available” basis to the fullest extent permitted by law. Using an AI travel assistant has inherent limitations, and you acknowledge that no warranty of any kind is made as to the accuracy, completeness, or reliability of the information and suggestions provided. In particular:

  • Informational Purposes Only: Any itineraries, recommendations, or travel information that VamoTrip provides (including attractions described as “hidden gems,” suggested routes, prices, availability dates, etc.) are for general informational and planning purposes. We try to keep information up-to-date, but travel data can change quickly (for example, hotels may become fully booked, attraction details may change, visa requirements or travel restrictions can update, etc.). Always verify critical information (such as visa requirements, health and safety advisories, booking details, and current prices or schedules) with official sources or the relevant Travel Partner before making decisions or payments.
  • AI Limitations: You understand that you are interacting with a machine-learning AI system, not a human travel agent. The chatbot may occasionally produce incorrect statements, misunderstand your query, or provide results that are incomplete or out of date. VamoTrip does not guarantee that any advice or information provided will be suitable or tailored to your personal circumstances. You should use your own judgment and common sense when following any itinerary or suggestion from the Service.
  • No Warranty of Service Quality: We do not warrant that the Service will meet your specific requirements or expectations, or that it will be uninterrupted, error-free, secure, or free of harmful components. While we aim for high availability and will work to fix bugs or issues, we do not guarantee continuous or flawless operation. Any material you obtain through VamoTrip is obtained at your own discretion and risk.
  • No Implied Warranties: To the maximum extent allowed by applicable law, we disclaim all warranties of any kind – whether express, implied, or statutory – regarding the Service and any results or content obtained through it. This includes any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or quality. We do not warrant that any travel arrangements suggested by the Service will meet your expectations, and we make no guarantee about the outcome of any booking you pursue through a third party.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our warranties are limited to the minimum scope and duration permitted by law.

Limitation of Liability

To the fullest extent permitted by law, VamoTrip and its creator(s) will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or related to your use of (or inability to use) the Service or any travel bookings or decisions you make based on information from the Service. This includes, but is not limited to, damages for lost profits or savings, lost opportunities, lost or corrupted data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

VamoTrip’s total aggregate liability to you for all claims arising from or related to the Service or these Terms will not exceed the greater of: (a) the total amount (if any) you have paid us for use of the Service in the six (6) months immediately prior to the event giving rise to liability, or (b) USD $100. (For most users, this will be $0, as VamoTrip currently does not charge fees.)

Third-Party Transactions: VamoTrip has no liability whatsoever for any act or omission of any Travel Partner or other third party. We are not responsible for any injury, loss, claim, accident, delay, or any damage of any kind that arises during or as a result of any trip or service you book with a third party, since we are not the provider of those travel services.

Release: You agree that you bear all risk for any activities you undertake based on information from our Service. To the extent permitted by law, you release VamoTrip (and our officers, directors, employees, agents, and affiliates) from any and all claims or liability related to your use of the Service or third-party services we link to. If you are a resident of California, you expressly waive California Civil Code §1542. If you reside elsewhere, you waive any similar protections to the extent permitted by applicable law.

Exceptions: Nothing in these Terms limits or excludes our liability for anything that cannot be excluded by law, such as liability for death or personal injury caused by our gross negligence or willful misconduct, or liability for our fraud or fraudulent misrepresentation. However, we do not assume any liability for ordinary negligence, and in no event will we be liable for any loss or damage that was not reasonably foreseeable.

Because some jurisdictions do not allow the exclusion or limitation of liability for certain damages, in such jurisdictions our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to be responsible for and defend VamoTrip, its operators, and affiliates against any claims, damages, losses, or expenses (including reasonable legal fees) that result from: (a) your use of the Service in violation of these Terms or the law, or (b) your infringement of another person’s rights, or (c) your misuse of any third-party service accessed through the Service. We may choose to conduct our own defense, in which case you agree to cooperate. This obligation continues even after you stop using the Service.

Termination and Suspension

By You. You may stop using VamoTrip at any time. Since the Service does not require registration, no further action is needed to end your use.

By Us. We may suspend or restrict your access to the Service, in whole or in part, at our discretion and without notice, if we believe that: (i) you have violated these Terms or applicable law; (ii) your conduct threatens the security, stability, or integrity of the Service; or (iii) we discontinue or materially alter the Service (for example, ending a beta phase). We may also impose usage limits or block access if we determine it is reasonably necessary to protect the Service or other users (for example, if you generate excessive automated requests).

Effect of Termination. If we suspend or terminate your access, you will no longer be able to use the Service. We will not be liable for any compensation, reimbursement, or damages in connection with such suspension or termination.

“AI Assistant” – No Professional Advice or Contracts

  • No Professional Advice: Any information or suggestions provided by the chatbot do not constitute professional advice (such as legal, financial, or medical advice), and should not be treated as such. Always seek professional or expert guidance where appropriate. VamoTrip offers general travel information and ideas, but we are not licensed travel agents or advisors.
  • No Binding Commitments by AI: The chatbot may provide information about prices, availability, or even say phrases like “I can book that for you.” However, the AI cannot enter into contracts on behalf of VamoTrip or any third party. Any “agreement” or “promise” stated by the AI is not legally binding. Actual bookings or purchases only occur when you follow through on partner websites or explicitly confirm a reservation through the proper process with a Travel Partner. Neither VamoTrip nor any travel provider is bound by something the AI assistant might have stated. (For example, if the AI quotes a price or availability that turns out to be incorrect, neither VamoTrip nor the third party is obligated to honor it.)
  • User Responsibility: You are responsible for making the final decision on any travel plans. Use the information from the chatbot as one input among others, and always double-check key details. If you choose to rely on the AI’s suggestions, you assume the risks of doing so.

Governing Law and Dispute Resolution

Because we operate internationally, we aim to comply with consumer protection laws in multiple jurisdictions. However, these Terms shall be governed by the laws of England and Wales, without regard to its conflict of law principles, unless otherwise required by applicable law (for example, if you reside in a country with mandatory consumer protection laws that override this agreement).

Jurisdiction: Except where prohibited by law, any disputes or claims arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. We and you agree to submit to the personal jurisdiction of such courts. If you are a consumer resident in the European Union, you may also be entitled to bring claims in your local courts under applicable consumer protection laws.

Arbitration and Class Action Waiver (for U.S. Users): If you are using the Service in the United States, you and VamoTrip agree that any dispute or claim arising out of or relating to the Service or these Terms shall be resolved by binding arbitration on an individual basis, not by a court trial (jury or judge) and not as part of a class or representative action. This agreement to arbitrate is governed by the Federal Arbitration Act and remains in effect after termination of these Terms. You and VamoTrip waive any right to participate in a class action or class-wide arbitration. Opt-Out: If you do not wish to agree to arbitration for disputes, you must let us know in writing within 30 days of first accepting these Terms, otherwise this arbitration clause will be binding. (If you opt out, you can instead choose to resolve disputes in the courts specified above.) The arbitration will be administered by a neutral arbitrator (for example, under the AAA Consumer Arbitration Rules) and we will share the arbitration costs as required by the rules or as deemed fair by the arbitrator. Jurisdiction and exceptions: Despite the above, either party may bring a claim in small claims court for eligible matters, and either party may approach a court of competent jurisdiction to seek an injunction or other equitable relief to protect intellectual property or prevent misuse of the Service. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect. (If you are not a U.S. user, the above arbitration provision does not apply to you.)

Miscellaneous

  • Entire Agreement: These Terms (along with the Privacy Policy and any other guidelines or additional terms we provide for specific features) constitute the entire agreement between you and VamoTrip regarding the Service. They supersede any prior agreements or communications between us relating to the Service.
  • No Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. If we do expressly waive any provision of these Terms, such waiver is limited to the specific instance and context in which it was given.
  • Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court or tribunal of competent jurisdiction, that provision shall be deemed severable from these Terms and will not affect the validity and enforceability of the remaining provisions, which will remain in full force.
  • Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to an affiliate, a successor in interest (e.g., in the event of a merger, acquisition, or sale of assets), or any other party at our discretion. These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
  • No Agency: No joint venture, partnership, employment, or agency relationship is created between you and us as a result of these Terms or your use of the Service. You do not have any authority to bind VamoTrip in any respect.
  • Force Majeure: We are not responsible for delays or failures caused by events outside our reasonable control. This includes natural disasters, government actions, wars, terrorism, labor disputes, pandemics, internet or power outages, or similar events that make it impossible to provide the Service.
